Terms of Service
Last updated: October 15, 2026
These terms govern your use of Capsule — a social feed where people create interactive apps (“capsules”) with AI and share them. Capsule is operated by Nadir Balena, Milano, Italy (individual operator; pre-launch beta, not yet commercially operated) (“we”, “us”). By creating an account or using Capsule you agree to these terms and to our Privacy Policy, Brand & IP Policy, and Notice & Takedown process.
Your account
- You must be at least 14 years old, or the higher minimum age for using online services in your country. If you are under 18, you confirm a parent or guardian has agreed to these terms.
- Keep access to your sign-in email secure; you're responsible for activity on your account.
- One account per person. Don't impersonate other people, brands, or organizations.
Your content
You own the capsules, comments, and other content you create, to the extent the law gives anyone ownership of them (see AI-generated content below). By publishing on Capsule you grant:
- Us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and adapt that content to operate and promote Capsule — for example rendering your capsule in other users' feeds, generating previews and thumbnails, and showing it in share links.
- Other users a worldwide, non-exclusive, royalty-free license to view, play, and share your published capsules within Capsule, and to remix them: copy a capsule into their own account, change it, and publish the result with attribution to you.
These licenses end when you delete the content or your account, except for copies other users had already remixed, and for content we must keep for legal reasons. Unpublished capsules are private and licensed to us only so we can store and show them to you.
You're responsible for what you publish, including AI output you choose to share. Only publish content you have the rights to — in particular, see our Brand & IP Policy before using anyone else's brand, logo, product, or character.
AI-generated content
- Capsules and other AI outputs are generated by machine-learning models. They can be inaccurate, incomplete, or unsuitable for your purpose, and are provided as-is; use judgment before relying on or publishing them.
- AI output may not be protected by copyright, and other people may get similar results from similar prompts. We don't promise that your capsule is unique or that you can stop others from making something similar.
- Capsules are made with AI, and we may label them as AI-generated. If your capsule includes an AI chat or AI character, don't present it as a real person; people must be able to tell they are talking to an AI.
- Don't use Capsule's AI features to produce content that the model providers' usage policies prohibit.
Acceptable use
Don't use Capsule to:
- publish illegal content, harassment, hate, sexual content involving minors, or credible threats;
- make capsules that phish, mislead, collect personal data without consent, distribute malware, or exfiltrate data;
- infringe others' intellectual property, trademarks, or privacy, or imply a brand's endorsement you don't have;
- spam, scrape at scale, or artificially inflate engagement;
- circumvent usage limits, safety systems, or the capsule sandbox.
Anyone — with or without an account — can report content in the app or through our Notice & Takedown process. We may remove content, limit features, or suspend accounts that break these rules or the law. When we remove or restrict your content we'll tell you what we did and why, and you can reply to contest the decision.
Rewards, promotions and brands
Creators can attach rewards (links, vouchers, QR codes, prizes) to capsules, and these may lead outside Capsule. We don't control external sites or honor third-party offers — the creator or business making an offer is responsible for it. If you run a contest, prize draw, or promotion, you are responsible for complying with the laws that apply to it (for example, in Italy, prize promotions are regulated by D.P.R. 430/2001 and may require notification to the Ministry). Businesses using Capsule for marketing must disclose sponsored content as advertising.
Plans, limits and payments
- Each plan includes a number of AI generations per calendar month (creating a capsule and each refinement count as one), shown on the pricing page. Unused generations don't roll over. Additional fair-use limits protect the service from abuse.
- Who sells and bills: paid plans and packs are sold through Link, the merchant-of-record service of Stripe (“Stripe Managed Payments”). For each purchase Stripe acts as the reseller: it processes the payment, calculates and collects VAT and other sales taxes, issues receipts and invoices, and handles payment support, refunds and disputes under its own terms, which are shown at checkout. Your card statement shows “LINK.COM*” followed by our name. We provide the Capsule service you buy and remain responsible for it.
- Pro and Brand are recurring subscriptions (monthly or yearly), charged automatically at the start of each period. You can cancel anytime from the pricing page (“Manage plan”) or your Link account and keep your plan until the end of the paid period.
- Commercial use: using Capsule to market a business, a product, or a client's brand (for example branded promotions, vouchers, or product configurators) requires the Brand plan. Personal and creative projects are fine on every plan.
- Free trial: your first Pro subscription may include a free trial, offered once per account. A payment card is required to start it. Unless you cancel before the trial ends, the subscription starts automatically and your card is charged the price shown at sign-up; a reminder is emailed before the first charge. During the trial a reduced number of generations is available, as shown on the pricing page.
- Generation packs are one-off purchases of extra generations. They are used only after your plan's monthly generations run out, are valid for 12 months from purchase, can't be exchanged for money, and expire with your account.
- Right of withdrawal (EU/UK consumers): you normally have 14 days to withdraw from a digital service or digital content contract. Because plans and packs are delivered immediately, when you buy you ask us to start right away and acknowledge that you lose the right of withdrawal once delivery has started; you do this on the pricing page before checkout. Otherwise, payments already made aren't refunded except where the law requires or where Stripe grants a refund under its own policies.
- Prices and plan limits may change; we'll tell you before your next renewal and you can cancel before it applies.
Our service
The Capsule platform, name, logo, and software (excluding your content) belong to us; these terms don't give you any right to use them except to use Capsule. We provide the service “as is”, without warranties beyond those the law makes mandatory, and may change or discontinue features.
Liability
To the maximum extent permitted by law, we aren't liable for indirect or consequential loss, and our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim or €100. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, gross negligence or wilful misconduct, or any other liability or consumer right that cannot be limited by law.
If you use Capsule for business purposes, you agree to compensate us for claims by third parties arising from content you published or your breach of these terms.
Termination
You can delete your account at any time in Settings. We may suspend or terminate accounts that violate these terms or create risk for other users or the service; for serious or repeated infringement (including repeat copyright or trademark infringement) we will terminate the account.
Law and disputes
These terms are governed by the laws of Italy, and disputes go to the courts of Milano, Italy. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and can bring a claim in your local courts. Before going to court, please contact us at legal@thecapsuleapp.com — most things can be sorted out quickly.
Changes
We may update these terms. For material changes we'll post the new version here with an updated date and tell signed-in users in the app before the changes take effect; if you don't agree, you can stop using Capsule and delete your account.
